Living Trust and Wills
Living trusts and wills both direct asset distribution, but a living trust avoids probate, is private, and performs during your lifetime (including incapacity), while a will only takes effect after death, and has a possibility of going through public probate, and is used to name guardians for minors. A “pour-over will” is usually paired with a trust to manage assets not transferred before death.
